SC Refuses to Delay Hearing on Election Commissioners Appointment Law

The Supreme Court on Wednesday refused to defer the hearing on the 2023 law governing the appointment of the Chief Election Commissioner and Election Commissioners. A bench comprising Justices Dipankar Datta and Satish Chandra Sharma told the Centre that the issue was “more important than any other case.”
During the proceedings, the court observed that lawmaking is the prerogative of Parliament and that courts cannot direct the enactment of legislation.
Under the 2023 law, the selection committee for appointing Election Commissioners includes the Prime Minister, a Union Minister nominated by him, and the Leader of the Opposition in the Lok Sabha. Petitioners have challenged the law, arguing that it compromises the independence of the appointment process.
