The Punjab and Haryana High Court will hear a habeas corpus petition today filed by Iman Singh Khara, legal advisor of Amritpal Singh.
The court had previously asked Khara to provide evidence of Amritpal being in illegal police custody and to inform the court about the police station where he has been kept. Although Amritpal had shared some videos and an audio clip, it seems that he is not in police custody.
In the petition, Khara claims that Amritpal Singh has been kept in illegal custody by the police, and his family members are not being informed about this. Khara also highlighted a threat to Amritpal’s life and has appealed to the High Court to release him from illegal custody and issue instructions to the Punjab government to appoint a Warrant Officer.
During the hearing on March 29, the High Court had asked Khara to provide evidence of Amritpal being in illegal custody before issuing any orders. Last week, the High Court had heard a similar petition filed by Khara regarding the arrest of Amritpal’s colleague Prime Minister Bajoke. The High Court reprimanded Khara during the hearing and questioned the basis of his petition and why he did not go to the Assam High Court instead.
During the March 21 hearing, the Punjab government informed the High Court that Amritpal Singh is still missing.The High Court criticized the Punjab government for failing to locate Amritpal Singh despite their efforts and asked what the 80 thousand policemen were doing. The court did not believe the police story and questioned why Amritpal was able to escape while all his men were arrested.
In response, the Punjab government said that they were prevented from using force despite having weapons, and some matters were too sensitive to be explained in court. They assured the court that they are doing their best to locate Amritpal Singh.
This case raises important issues concerning police custody, habeas corpus, and the role of the courts in ensuring justice. The right to habeas corpus is a fundamental right enshrined in the Indian Constitution, which guarantees the right to personal liberty and protects individuals from arbitrary detention.
