Govt Issues Guidelines to Protect Victims from Courtroom Harassment

Jaipur: In response to complaints about the mental harassment faced by women, children, and victims of sexual offences during court proceedings, the state government has issued important directions to ensure a more sensitive and respectful judicial environment.
Public Prosecutors, Special Public Prosecutors, and Assistant Public Prosecutors (APPs) have been instructed not to ask questions that are derogatory, humiliating, or cause mental distress to victims in cases related to the POCSO Act, crimes against women, and offences involving children.
A circular issued by Principal Secretary of the Law and Legal Affairs Department, Raghavendra Kachhwaal, emphasizes that cases involving women and children must be handled with sensitivity, dignity, and confidentiality. The move is aimed at providing victims with a safer and more respectful experience in courts.
The government has also directed authorities to expedite case proceedings by increasing the use of digital processes. Summons and notices should be served through email, WhatsApp, SMS, and other electronic means wherever possible. The circular further stresses the preservation of electronic records and the promotion of digital communication in judicial procedures.
Additionally, the use of Vulnerable Witness Deposition Centres has been made mandatory for vulnerable witnesses. Authorities have been instructed to ensure complete protection of victims’ identities, personal information, and privacy throughout the legal process.
