Jaipur High Court Cracks Down on Illegal Recording of Court Proceedings

In Jaipur, the High Court took serious note of a person recording court proceedings on a mobile phone and ordered the confiscation of the device. The court also directed the Ashok Nagar police station to initiate legal action against the individual involved.
Additionally, the court issued contempt notices to petitioner Kamal Rathod and his driver, Anil Suman, asking them to explain why contempt proceedings should not be initiated against them. The matter has been directed to be placed before the Acting Chief Justice so the petitions may be listed before another bench instead of the present one.
Justice Anup Kumar Dhand passed these directions while hearing Kamal Rathod’s petition. The court observed that secretly recording court proceedings amounts to interference in the judicial process and lowers the dignity of the court, thereby constituting contempt of court.
During the hearing of a criminal petition, the court noticed that a person was recording the proceedings without permission on his mobile phone. When caught red-handed, he allegedly attempted to delete the recordings. Upon questioning, he identified himself as the driver of petitioner Kamal Rathod and admitted he was recording the hearing related to Rathod’s case.
The court termed the act a clear interference in judicial proceedings and noted that Rule 3(vi) of the Rajasthan High Court Video Conferencing Rules, 2020 explicitly prohibits recording court proceedings without authorization.
