Rahul Gandhi Granted Bail in Defamation Case, Challenges Conviction

Rahul Gandhi has been granted bail by the Surat Sessions Court in a defamation case related to comments he made during a political campaign in Karol in April 2019.The Congress leader had been sentenced to two years in jail by the Court of Chief Judicial Magistrate, following which he was disqualified as MP of Lok Sabha. The individual’s sentence was temporarily set aside, and he was permitted to be released on bail so that he could file an appeal against his conviction within a period of 30 days.

On March 23, 2022, Rahul Gandhi was found guilty by the Chief Judicial Magistrate’s court for his statement “why all thieves share the Modi surname” that was made during a political campaign in Karol in April 2019. As a consequence, he was sentenced to two years in prison and was stripped of his position as MP of Lok Sabha. Following this, Rahul Gandhi filed an appeal in the Surat Sessions Court to challenge his conviction, which resulted in his subsequent release on bail.

As part of the appeal process, two applications have been submitted – the first one is for Suspension of Sentence, which is essentially an application for regular bail, and the second application is for Suspension of Conviction.If the second application is allowed, his membership of the Lok Sabha will be restored, subject to the issuance of notification of the LS Secretariat in this regard.

During the hearing, Rahul Gandhi counsel argued that the case against him was politically motivated and that there was no evidence to support the allegations of defamation. The counsel further submitted that the statement made by Gandhi was not intended to defame anyone and that it was made in the context of a political campaign.

The prosecution, however, argued that Rahul Gandhi statement had caused immense harm to the reputation of Prime Minister Narendra Modi and that it was made with the intention of defaming him. The prosecution further submitted that the statement was made in public and that it had caused considerable damage to the image of the Prime Minister and his family.

After hearing both the sides, the Surat Sessions Court granted bail to Rahul Gandhi. However, the Court has not stayed his conviction yet, and the case will be heard next on May 3.
