HC Acquits Man in 14-Year-Old Double Murder Case, Sets Aside Life Sentence

The Rajasthan High Court has acquitted the accused in a 14-year-old double murder case from Nahargarh and set aside the trial court’s order dated December 15, 2017, which had sentenced him to life imprisonment.
A division bench comprising Justice Mahendra Kumar Goyal and Justice Bhuvan Goyal passed the order while allowing the appeal filed by accused Vijay Singh.
The court observed that the prosecution’s claim that the parents of the deceased were eyewitnesses was not supported by the evidence on record. The mother stated that when she reached home, the door was open, blood was scattered inside, the boy was lying on the bed, and the girl was on the floor. She also admitted that several people were present at the spot, but she neither saw anyone apprehending the accused nor asked anyone about the incident. The court held that her statement indicated she arrived after the occurrence and was not an eyewitness.
The father also testified that by the time he reached home, the police had already taken the children to the hospital. The bench noted that these statements created serious contradictions in the prosecution’s case and failed to establish a complete chain of circumstances linking the accused to the crime.
The court concluded that the prosecution had failed to prove the charge of murder beyond reasonable doubt and therefore acquitted the accused. Advocate Rajesh Goswami appeared on behalf of Vijay Singh.
The case originated from a complaint lodged by Manjeet Singh on August 14, 2012, alleging that Vijay Singh had murdered his son and daughter.
During the hearing, the defence argued that the parents claimed to have been present during the incident, but if that were true, they would have tried to save their children. The defence also pointed out that the father himself admitted that the police had taken the children to the hospital, further weakening the prosecution’s version.
